Where both parties are motivated to formally separate, Split Easy is suitable where there are no domestic violence orders, potential bankruptcy proceedings or pre-nuptial agreements in place. Split Easy will check this by asking some simple screening questions before you begin to use the platform.
Split Easy makes the legal process of divorce and separation simple and easy to understand and navigate, reducing stress and animosity between the separating parties.
Split Easy permits, and in fact encourages, direct contact between spouses for all communication and negotiation of assets and child care.
By using the Split Easy platform, couples are empowered to reach a legal conclusion on the split of their own assets and child sharing plans which is much more efficient.
The anticipated time frame to settle can be reached in less than 2 months using Split Easy, whereas similar negotiations commonly take 18 months with family lawyers. A potentially faster dissolution to the relationship reduces the impact and stress on all involved parties including children, friends and family.
Split Easy is significantly more cost-effective than engaging family lawyers, many of whom accumulate vast fees from minute, hourly or daily rates with little incentive therefore to resolve issues quickly. As each party often engages their own counsel for representation, costs for the couple are often duplicated, meaning it is not uncommon for divorces to cost in excess of $60,000 to $200,000 or more when lawyers are engaged to act. In contrast, you can try the Split Easy platform for free before you will be asked to pay anything. The significant savings gained from using Split Easy allows individuals to begin building a much brighter future for themselves and any involved children.
Where the separating parties cannot agree, Split Easy is able to suggest a reasonable split of the family asset pool using a tested algorithm, at only an additional nominal cost.
Split Easy is adaptive to the differing divorce requirements of any State or Territory in Australia.
Split Easy is open 24/7, 365 days of the year, allowing couples to progress their separation at a pace and time that suits them.
Split Easy provides an impartial mediation service using skilled and trained professionals to resolve sticking issues.
Split Easy will never charge you for photocopying, scanning documents or other administrative tasks. Ever.
Once all items have been agreed upon, Split Easy will produce the Consent Orders along with the actual Application for Consent Orders that need to be signed and lodged to the Family Law Court of Australia for approval and stamping.
Split Easy will also provide a comprehensive checklist of items you need to attend to in order to complete the process.
Split Easy will automatically generate the Consent Orders which are needed to lodge with the Family Court, which demonstrates that you and your ex-partner have undertaken due process in the split of assets and the future parenting of any children. Once this is assessed by the Courts and you have then been separated for 12 months, only then can an application for divorce be made. The application for divorce is itself quite simple and inexpensive. Some couples are happy to be formally separated and not file for divorce unless they are looking to re-marry.
Split Easy requires a significant amount of information to be able to guide you through the process as efficiently as possible. You may need to be in contact with banks, valuers, accountants, superannuation funds and other external parties to obtain the required information to complete the process.
Providing you and your ex-partner can agree and depend on the complexities of your personal situation, you should be able to complete the entire process within 2 to 12 weeks.
The average waiting time for couples to have their case heard before the courts are currently 17 months in Australia.
If your ex-partner refuses to accept his or her invitation to participate in the Split Easy process, then you, as the initiating party will be furnished with a full brief of all the pertinent information provided.
Our research suggests that this document can save you between $5 - $10k in legal fees should you need to engage family lawyers down the track.
Split Easy uses a proprietary algorithm based on historic family court outcomes for similar couples, that will help guide you on the likely acceptable view by the court on the split of assets (additional charges apply - refer to pricing tab above). Should you still not reach agreement on the allocation of assets or on a parenting plan, then you may decide to enter mediation.
Split Easy have formed an alliance with Family Resolve, a professionally qualified and experienced team of family mediation specialists. If you agree to go down this path, Split Easy will provide Family Resolve with a full brief of your circumstances in addition to an exception report that highlights the items that are subject to dispute. You can continue with Split Easy once the issues are resolved.
During separation, each situation differs in terms of whether children are involved and the extent to which couples agree on the split of assets, which is why you will only ever pay for what you need when using the Split Easy platform. Use the quick calculator in the pricing tab above to determine the cost for your personal situation.
Keep in mind that traditional family lawyers usually charge tens of thousands of dollars to navigate couples through the legal system. Split Easy was developed to empower couples to undertake the same process at a fraction of the cost of the traditional family lawyer.
To ensure that you are 100% confident in obtaining value from the platform, you can access the first 3 modules without charge - the Personal Information Manager, Assets & Liabilities Manager and the Living Arrangement Manager (if children are involved). Once you input this information, payment can then be made securely via debit or credit card before your ex-partner is invited to review the details you have entered.
If you find yourselves at a stalemate and require professional mediation services, then yes, it will cost extra. Family Resolve (our preferred Mediation partner) charge a one-off $275 each spouse. The mediation process includes an initial review of the documentation provided by Split Easy (flagging the item(s) in dispute).
This is followed up with a one-hour discussion between the mediator and each individual spouse. The mediation process concludes with a one-hour joint consultation together with the mediator.
Unfortunately not. The courts require that couples have undergone due process together to determine a reasonable split of all assets, liabilities and superannuation and, for any children involved that a parenting plan has been agreed and is in place.
